Public server meaning one that has a web base registration. Yes you are open to a law suite. Not that you will get arrested but you can get sued by Blizzard and or Mangos if they so choose to do so.

Well ... you can create it for fun and test.
But if you start collecting $$ from players to play in your server, i believe blizzard will go after u.

Collecting money really has nothing to do with. If you run a public server with web account registration you are takeing a chance. Everybody out there now with public servers are taking a chance. So if you get a letter some day saying that you have been entered in to a class action law suite by blizzard or mangos then don't say you wheren't warned.

Its... Blizzard... hahaha. They basically could try sueing you for what they want. That or you can try to read all of the (C) notes to see if a stated fee is listed. Basically, it won't be a traffic ticket for going 10 miles over the speed limit

Does it matter? How much can you afford? Are you willing to dish out $100,000? $10,000? $1000? Perhaps only $100. Would you pay them $100 and STILL loose your server?

These private servers are for testing and proof of concept really. I'll agree that the server can get boring without anyone else really playing but that's not what it's for. You are opening yourself up for a lawsuit if you go public. Right now the public servers are just making small ripples in the Blizzard pond and it's probably not worth the legal fees to hunt down all the illegal servers. But get large enough and Blizzard will make an example out of you and you will lose.

Keep it safe and keep it private in my opinion. Share with your friends but do not make it a wide open registration and certainly do not charge for it or even ask for donations.

exactly, don't ask for donations and DEFINITELY don't charge anything. keep it private, or as Gandalf once said: "keep it secret, keep it safe"

I have a private server, that only my friends have access to, and we play once every two weeks, it's actually a semi-substitute for D&D for us, since we're spread all over the USA now. I've got a registration page, but I set it up to require an authentication #, and only I can give those out. we basically all log on, and run a raid. which is about all you can really do on a low population server.

We all have paying accounts on Blizzards servers, and I intend to keep paying monthly to play on the blizz servers, since it's so much fun. Especially watching my little Gnome warrior pwn Tauren by the dozen while wandering about in Mulgore HAHAHA
